Permasalahan Hukum di Rumah Sakit: Malpraktik dan Pentingnya Informed Consent

Hospitals as healthcare service institutions, play a vital role in safeguarding patient safety and well-being. Behind this noble function, however, hospitals remain vulnerable to various legal challenges, particularly those related to medical malpractice and issues surrounding informed consent. Medical malpractice generally occurs as a result of negligence or deviations from professional standards, which can cause serious harm to patients. Informed consent, on the other hand, refers to a patient’s approval of medical procedures after receiving clear, comprehensive, and understandable information from the physician. This study employs a literature review method with a systematic approach, drawing from various academic databases such as PubMed, Cochrane Library, Google Scholar, SINTA, and Scopus. The findings indicate that medical malpractice not only causes harm to patients but also has the potential to trigger legal claims that disadvantage hospitals. Furthermore, inadequate implementation of informed consent whether due to weaknesses in standard operating procedures, human error, or the lack of awareness among healthcare professionals may threaten patients’ rights and serve as a source of legal disputes. Therefore, a thorough understanding of health law, alongside the reinforcement of informed consent practices across all levels of service, is essential.
